Terms

These terms cover your use of this website and what you can expect if you ask us to build a dashboard for your practice. DNTL Desk is a product of NBLK® LLC (New York) and NBLK® Global Ltd (United Kingdom).

The work itself is governed by the written agreement we sign with you and by the business associate agreement. Where either of those and these terms disagree, the signed agreement wins.

1. Using this site

You may read this site, use the demo and book a call. Please do not:

  • Try to break, overload or get around the booking form or its limits.
  • Copy the site or its contents to pass off as your own.
  • Use anything here to build a competing product.

2. Booking a call

Booking a call costs nothing and commits you to nothing. It is a conversation, not an order, and no contract is formed by booking one.

Please do not put patient information into the booking form. It is a sales enquiry form and is not covered by the business associate agreement.

We may decline to hold a call, or to take on a piece of work, without giving a reason.

3. What is on this site

The prices, timescales and savings shown here are examples and starting points, not an offer. The payback figures on the home page are worked out from numbers you type in, and are illustrations only. Your price depends on what you choose.

The demo runs on made-up patients. It is there to show how a dashboard works, not to describe any real practice.

4. What we sell

A dashboard built for one practice, connected to the practice software you already use. What it does is agreed in writing before work starts.

Builds run from $1,200 to $6,500, paid once, depending on the features you choose. There is no software licence and no renewal fee. [CONFIRM: whether this range should appear in the terms at all, or only in the written agreement.]

5. Price, payment and tax

Your price is fixed in the written agreement before work starts. [CONFIRM: the payment schedule, what happens if a project is cancelled part way, and whether any part is non-refundable.]

[CONFIRM: how sales tax and VAT are treated, for US and UK practices.]

6. Ownership and handover

You own the build. At handover you receive the full build and a certificate of ownership, and it runs on your own account.

What stays ours: the tools and methods we use to produce builds, and anything we developed before or outside your project. You get the dashboard, not the workshop.

[CONFIRM: exactly what the certificate of ownership grants, in legal terms.]

7. The 90-day guarantee

For 90 days after handover we fix anything that does not work as agreed, at no cost. [CONFIRM: what the guarantee covers and excludes, and whether it is a warranty or a goodwill promise.]

8. Hosting, if you choose it

You own the build outright. If you would like us to host it and keep it running, there is a small monthly hosting fee, and you can move it to your own account at any time.

[CONFIRM: the notice period, what happens to data on moving, and whether the fee is fixed.]

9. Patient data and the business associate agreement

Where we handle patient information on your behalf, a business associate agreement is signed before we touch a single record, and it governs that handling. Nothing in these terms reduces it.

Patient data stays in your own account and is encrypted. No patient information is collected by this website.

[CONFIRM: the UK equivalent arrangement for practices served by NBLK® Global Ltd.]

10. Practice software and other services

A dashboard connects to practice software we do not own or control, such as Open Dental. We are an authorized Open Dental developer. If that software changes, or your access to it changes, your dashboard may need work, and we are not responsible for their decisions or their outages.

You are responsible for holding valid licences for the software your dashboard connects to.

11. What you give us

You keep ownership of everything you give us. You let us use it for as long as we need to in order to do the work.

You confirm you are allowed to give it to us. If you send us something you should not have, tell us and we will delete it.

12. Liability

[CONFIRM: this whole section with the reviewer. The text below is a placeholder, not a position.]

Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.

13. Which law applies

[CONFIRM: governing law and jurisdiction for each company, and which applies to which customer.]

14. Changes

We may update these terms. The date at the top says when. Work already agreed is governed by the terms in force when it was agreed.
